Privacy Policy

This Privacy Policy describes how Super Farmacia Nueva, Inc. (“Farmacia Nueva”, “we”) collects, uses and protects your information when you visit fnueva.com (the “Site”) and when you use our Prescription Portal at rxintake.fnueva.com (the “Portal”). By using the Site or the Portal you agree to the practices described here.

2. Information we collect

On the Site (fnueva.com)

The Site is informational. It does not require an account or any personal data. We collect only:

  • Usage and analytics data: we use Google Analytics to understand how the Site is used (pages visited, device type, country, traffic source). IP addresses are anonymized. Google may set cookies for this purpose; see Google’s privacy policy.
  • Browser preferences: the language and theme (light/dark) you choose are stored locally in your browser. They are not sent to our servers.

If you contact us by phone, email (info@fnueva.com or recetas@fnueva.com) or WhatsApp, we handle the information you send under this policy and applicable law. Note that WhatsApp and email are third-party services with their own privacy policies.

On the Portal (rxintake.fnueva.com)

To process your prescription, the Portal collects:

  • Identification data: full name, date of birth, phone number and email address.
  • Customer type: new or existing.
  • Images: a photo of your prescription and, for new customers, a photo of your health-plan card. Images are converted to PDF for processing.
  • Technical data: IP address, browser (user agent), selected language and submission date/time, used for security and abuse prevention.
  • Bot verification: the Portal uses Cloudflare Turnstile to confirm you are a person. See Cloudflare’s privacy policy.

3. Protected health information (PHI)

The information you submit through the Portal (prescriptions, health-plan details and your identification data) is protected health information under the federal HIPAA law (Health Insurance Portability and Accountability Act). Farmacia Nueva uses it solely to fill your prescription, coordinate delivery and communicate with you about your order, as permitted by law.

Our Notice of Privacy Practices describes your HIPAA rights and how we may use and disclose your health information in more detail. It is available at the pharmacy and on request by calling (787) 869-2290.

4. How we use your information

  • To fill and prepare your prescription.
  • To coordinate home delivery or pickup at the pharmacy.
  • To contact you if we need to clarify anything about your prescription or health plan.
  • To protect the Site and the Portal against fraud, abuse and unauthorized access.
  • To comply with legal and regulatory obligations that apply to pharmacies in Puerto Rico and the United States.

We do not sell your information or use it for third-party advertising.

5. Where and how your information is stored

  • Portal data is stored on Cloudflare infrastructure (databases and file storage) in private containers with no public access.
  • All transmission is encrypted with HTTPS/TLS.
  • Only authorized Farmacia Nueva staff can view submissions, and every access is recorded in an audit log.
  • Your language and theme preferences are stored only on your device.

6. Retention and deletion

  • Portal submissions and their images are automatically deleted 90 days after creation by a daily automated process. Incomplete drafts are deleted sooner.
  • Once processed, your prescription becomes part of your pharmacy record, which we keep as required by Puerto Rico law and federal regulations.
  • Site analytics data is kept according to Google Analytics’ retention settings.

7. Who we share information with

We share information only with:

  • Service providers that help us operate the Site and the Portal (Cloudflare for hosting, storage and security; Google for Site analytics). They may use the information only to provide the service to us.
  • Your doctor, your health plan or other health-care providers, when needed to fill your prescription or process your coverage.
  • Authorities, when required by law.

8. Your rights

You may ask us for:

  • Access to the information we hold about you.
  • Correction of inaccurate data.
  • Deletion of your information, subject to legally required retention periods.
  • A copy of our Notice of Privacy Practices.

To exercise these rights, email info@fnueva.com or call (787) 869-2290. If you believe your privacy rights have been violated, you may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights (HHS OCR).

9. Minors

The Portal is intended for adults. A parent or legal guardian may submit a minor’s prescription on their behalf.

10. Security

We apply reasonable technical and organizational measures (encryption in transit, private storage, access control, rate limits, bot verification and audit logs). No system is 100% secure; if we detect an incident affecting your information, we will notify you as required by law.

11. Changes to this policy

We may update this policy. The current version will always be published on this page with its update date.
